In the United States, partial unemployment benefits are often available to part-time employees whose hours or pay were involuntarily reduced or who took part-time work while seeking full-time employment. Weekly reporting of all gross wages is required. Benefits decrease according to earnings, but some payments may still be issued, extending potential benefit duration.

The NYS DOL has adopted an hours-based system for partial unemployment. You can work up to seven days without losing full benefits if your hours do not exceed 30 and your earnings are under the maximum gross benefit rate, excluding self-employment. Benefits are now reduced based on total weekly hours rather than each day worked.

If your weekly part-time income is lower than your unemployment benefit, you may still qualify for full or partial payments. Part-time work generally involves fewer than 40 hours a week. All gross wages, including part-time earnings before taxes or deductions, must be reported when certifying benefits, even if they seem small.
