Most Canadian work permits require a valid job offer from a Canadian employer, with an LMIA needed in many cases unless an exemption applies. Once the offer is in place, applicants apply through the IRCC portal, submit passports and employment documents, pay application and biometrics fees, and attend a biometrics appointment.

Following recent updates to Canadian work permit rules, most foreign nationals already in Canada must apply online instead of at a port of entry. This includes both initial work permit applications and extensions. Those outside Canada may still qualify to apply for a permit when they arrive, subject to conditions.

Canada offers two categories of work permits: employer-specific, tied to a particular job, employer, and location, and open, allowing work for most employers without a job offer or LMIA. Required documents include a job offer, LMIA if applicable, passport, proof of qualifications, and sometimes proof of funds or a medical exam. Applications can be filed online or at a visa application center.

You have the right to file a complaint with your state's labor department if your wages are illegally withheld, which can occur if an employer withholds your full pay as punishment, for a cash shortage, or for unreturned property without a prior written agreement.

can an employer force you to work overtime

Under U.S. federal law, most employers can require employees to work overtime if business needs demand it, as long as wage laws are followed. Non-exempt employees must receive overtime pay for hours worked over 40 in a workweek. Federal law does not cap total weekly hours, except in certain regulated industries like trucking, aviation, or nuclear energy, where safety rules apply.
