In the U.S., part-time workers may qualify for partial unemployment benefits if their hours or pay were reduced involuntarily or if they accepted part-time work while seeking full-time employment. All gross wages must be reported weekly. Benefits are reduced based on earnings, but some payments may still be received, which can also extend your benefit period.

The NYS DOL now uses an hours-based approach for partial unemployment. You can work up to seven days weekly without losing full benefits if you work 30 hours or less and earn under the maximum gross benefit rate, not counting self-employment. Reductions are based on total weekly hours, not daily work.

If your part-time earnings don’t exceed your weekly unemployment benefit, you could still get full or partial payments. Part-time work typically means fewer than 40 hours weekly. When certifying benefits, all gross wages, including part-time pay before taxes or deductions, must be reported, even if the total is below your weekly benefit.
