
U.S. workers can often get partial unemployment benefits when working part-time, especially if hours or pay were reduced against their will, or if they are looking for full-time work but took part-time employment. Weekly gross wages must be reported. Benefits decrease with earnings, but some income may still be received, potentially extending the benefit period.

NYS DOL’s partial unemployment system now uses an “hours-based” approach. You can work up to seven days a week without losing full benefits if you work 30 hours or less and earn below the maximum gross benefit rate, excluding self-employment. Benefits are reduced in increments based on total weekly hours, not per day worked.

If your part-time earnings are less than your weekly unemployment benefit, you could still get full or partial payments. A part-time job is generally fewer than 40 hours per week. When certifying benefits, you must report all gross wages, including part-time income before taxes or deductions, even if they seem less than your weekly benefit.
