In the United States, part-time workers may get partial unemployment benefits if their hours or pay were involuntarily reduced or if they took part-time work while seeking full-time employment. You must report all gross wages weekly. Benefits are reduced according to income, but some payments may still be received, which can extend your total benefit period.

The NYS DOL now uses total weekly hours to calculate partial unemployment benefits. You can work seven days a week and still keep full benefits if you work 30 hours or fewer and earn under the maximum gross rate, excluding self-employment. Reductions are applied in increments based on weekly hours, not per day worked.

If your part-time earnings don’t exceed your weekly unemployment benefit, you may still get full or partial payments. Part-time usually means fewer than 40 hours per week. All gross wages, including part-time income before taxes or deductions, must be reported when certifying benefits, even if they seem smaller than your weekly benefit.
