In the United States, part-time workers can often collect partial unemployment benefits if their hours or pay were cut involuntarily or if they took part-time work while seeking full-time employment. All gross wages must be reported weekly. Benefits decrease with income, but partial payments may continue, extending the overall benefit period.

The NYS DOL now uses weekly hours to calculate partial unemployment benefits. Workers can work seven days a week without losing full benefits if their hours do not exceed 30 and earnings stay under the maximum gross benefit rate, excluding self-employment. Reductions are applied incrementally based on total weekly hours.

Even if your part-time pay falls below your weekly unemployment benefit, you may still qualify for full or partial payments. Part-time typically means working fewer than 40 hours weekly. When certifying, report all gross wages, including part-time income before taxes or deductions, even if it appears smaller than your benefit.
