Will Using a Phone While Driving Be Captured by Traffic Cameras?

Using a handheld phone while driving is prohibited. Traffic cameras monitor such behavior, and violations will be photographed and recorded, resulting in fines and demerit points. The captured images of drivers using phones can clearly show the driver's face, meaning only the driver's own license can be used to process the violation. According to the "Road Traffic Safety Violation Points Management Measures" officially implemented from April 1, 2022, drivers who make or answer handheld phone calls or engage in other behaviors that hinder safe driving will be penalized with 3 demerit points and a fine ranging from 20 to 200 yuan. 【Behaviors considered as driving】 include slow-moving traffic, intermittent driving, waiting at traffic lights, etc. 【Behaviors that hinder safe driving, such as using handheld phones】 include making or answering calls in handheld mode, or using handheld electronic devices to send/receive messages or WeChat by viewing the screen or operating the device, watching TikTok, Kuaishou, Weibo, or playing games. Even if the phone or electronic device is mounted on a holder, performing actions like sending/receiving messages, watching videos, browsing apps, or playing games by viewing the screen or operating the device is similarly dangerous as it diverts the driver's attention to the screen, thus also constituting a violation. However, using hands-free car phones, phone earphones, or speakerphone functions that do not require holding the device and do not affect safety is not considered a violation of handheld phone use. Although using Bluetooth is not penalized, it is still discouraged as it can distract the driver and compromise road safety.
