Liability Determination for U-Turn Collision with Through Traffic?
1 Answers
When a through vehicle collides with a vehicle making a U-turn, the U-turning vehicle bears full liability. If the vehicle has already completed the U-turn, it is considered to be proceeding normally forward, and any rear-end collision that occurs would make the through vehicle fully liable. Further details are as follows: Legal Basis: According to Article 49 of the 'Road Traffic Safety Law of the People's Republic of China': Motor vehicles are prohibited from making U-turns at locations with no U-turn or no left-turn signs or markings, as well as at railway crossings, pedestrian crossings, bridges, sharp curves, steep slopes, tunnels, or other sections of road where accidents are likely to occur. Additional Notes: Motor vehicles may make U-turns at locations without no U-turn or no left-turn signs or markings, provided that they do not obstruct the passage of other vehicles or pedestrians proceeding normally.
