Is Driving with an Expired License Considered Unlicensed Driving?

Strictly speaking, driving even one day after expiration constitutes unlicensed driving. However, there are two scenarios regarding an expired driver's license: one is when the validity period expires, within which the license can be renewed through inspection within one year and continue to be used. If it exceeds one year, the driver must retake the exams to obtain a new license. The other scenario is when only the inspection period has passed, which requires different handling procedures. When replacing a motor vehicle driver's license, the driver must undergo inspection by the traffic management department of the public security authority: 1. Drivers holding licenses for large buses, tractors, city buses, medium-sized buses, or large trucks must undergo inspection at the traffic management department within thirty days after the end of each scoring cycle. However, if there are no demerit points recorded during a scoring cycle, the inspection for that cycle is exempted. 2. Drivers holding licenses for vehicle types not specified in the third clause of this article, who are involved in a traffic accident resulting in death and bear equal or greater responsibility without having their license revoked, must undergo inspection at the traffic management department within thirty days after the end of the scoring cycle. 3. Motor vehicle drivers engaged in commercial transportation in a location other than their registered residence can directly undergo inspection at the transportation location after registering with the local vehicle management office for one year.
