According to the Road Traffic Safety Law, a sedan is generally designed to seat 5 people, including the driver. If the number exceeds 5 people including the driver, it is considered overloading. 1. Based on Article 2 of the "Scoring Standards for Road Traffic Safety Violations", if a motor vehicle driver commits any of the following violations, 6 points will be deducted: driving a commercial passenger vehicle (excluding buses) or school bus with passengers exceeding the approved capacity by less than 20%, or driving other passenger vehicles with passengers exceeding the approved capacity by more than 20%. 2. The following regulations shall be observed for motor vehicle passenger transportation: a. Road passenger vehicles shall not exceed the approved passenger capacity, except for children exempted from tickets as per regulations. When the passenger capacity is full, the number of exempted children shall not exceed 10% of the approved capacity; b. The cargo compartment of a truck shall not carry passengers. On urban roads, cargo motor vehicles may carry 1 to 5 temporary workers in the compartment if safety conditions are met; when the cargo height exceeds the compartment barrier, no person shall ride on the cargo; c. Children under 12 years old are not allowed to ride on the back seat of a motorcycle, and light motorcycles shall not carry passengers.
