The court supports classifying electric vehicles as motor vehicles. According to the national standard for general technical conditions of electric motorcycles and electric mopeds implemented since 2010, two-wheeled vehicles weighing over 40 kilograms with a speed exceeding 20 kilometers per hour are classified as electric mopeds or electric motorcycles, falling under the category of motor vehicles. The determination of whether a vehicle is a motor vehicle is based on national standards, considering three factors: the presence of pedals, speed, and weight, with the latter two being assessed by specialized agencies. A motor vehicle is defined as a wheeled vehicle driven or towed by a power device, used for transportation on roads, carrying passengers or goods, or performing specialized operations, including certain recreational facilities (such as electric balance bikes, electric scooters, and electric bicycles). Motor vehicles can be categorized into cars and car trains, motorcycles and mopeds, tractor transport units, wheeled special-purpose machinery, and electric vehicles, among others. Non-motor vehicles refer to transportation tools driven by human or animal power on roads, as well as vehicles with power devices but designed with maximum speed, unladen mass, and dimensions that comply with relevant national standards, such as motorized wheelchairs for the disabled.
