Former Dallas Cowboys quarterback Tony Romo is facing additional legal trouble after being cited for having an open container of alcohol in his vehicle during his recent arrest for operating while intoxicated in Wisconsin. The citation, obtained by Fox News Digital, lists "possess open intoxicants in MV-Driver" alongside charges for operating under the influence and unsafe passing on the right. The incident occurred last week following Romo’s participation in the Wisconsin Amateur Golf Championship.
On July 25, 2024, newly released police bodycam footage shows Romo insisting he had consumed "zero" drinks before requesting to call his attorney. When asked to step out of his 2020 Jeep, the former NFL star questioned, "Because I’m coming from a golf course, you think I’m drunk?" He recorded parts of the encounter on his phone before being handcuffed and transported to a nearby station for field sobriety tests.
The arresting officer noted Romo had red, glassy eyes and an odor of alcohol on his breath. After completing the tests, Romo refused a breathalyzer, stating, "I've heard from all the lawyers don't ever do that." An inventory of the vehicle revealed an open bottle of alcohol on the passenger seat.
Legal experts suggest that while an open container citation is a separate violation, the refusal to submit a breath test can result in an automatic driver’s license suspension in Wisconsin. "This is a common tactic for DUI suspects, but it doesn’t help with the other charges," said defense attorney Mark Wagner. "Refusal can be used as evidence of consciousness of guilt."
Romo, 44, retired from football in 2017 and has since worked as CBS’s lead color commentator alongside Jim Nantz. He called three Super Bowls, including the 2024 overtime thriller between the Kansas City Chiefs and San Francisco 49ers. The four-time Pro Bowler threw for 34,183 yards and 248 touchdowns over his career.
Meanwhile, Romo’s weekend schedule was disrupted. He withdrew from the M&P Group Texas State Open, where he was expected to appear. Social media reaction has been mixed, with some fans mocking his claim of zero drinks and others defending his right to legal counsel.
Romo is scheduled to appear in court on September 21. Neither he nor his representatives have issued a public statement.
