As of August 27, 2025, the Herkimer Police Department is releasing new details after one of its officers was struck by a vehicle on Protection Avenue the previous day. The incident, which occurred at approximately 12:02 p.m. on August 26, has raised urgent questions about roadside safety for law enforcement personnel.
The officer was actively assisting the New York State Police with an unrelated investigation on Protection Avenue when a passing vehicle failed to slow down or move over, striking the officer. The impact threw the officer off balance and caused immediate injuries. Colleagues on scene provided emergency first aid before the officer was transported to a local hospital. According to a statement released by the Herkimer Police Department on August 27, the officer is in stable condition and is expected to recover fully. The department has not released the officer’s name, citing privacy concerns.
The driver of the vehicle remained at the scene and is cooperating with investigators. Preliminary reports indicate that the driver was not impaired, but the exact cause of the failure to yield is still under review. The Herkimer Police Department is handling the traffic investigation, while the New York State Police continue their separate probe. Authorities have not yet announced any charges, but the case is expected to be presented to the Herkimer County District Attorney’s office for review of potential violations of New York’s Move Over Law.
Under New York State law, drivers are required to slow down and, if possible, move over to an adjacent lane when approaching any stopped emergency vehicle with lights flashing, including police cars, ambulances, and fire trucks. Violations of the Move Over Law can result in fines, points on a driver’s license, and even criminal charges if an injury occurs. “This incident serves as a stark reminder of the dangers officers face every day,” said a Herkimer Police Department spokesperson in a statement. “We urge all motorists to remain vigilant and obey the law whenever they see emergency lights.”
Local residents expressed shock and concern over the incident. “It’s terrifying to think that someone working to keep our community safe could be hurt this way,” said Maria Gonzalez, a long-time Herkimer resident. “I hope the officer makes a full recovery and that the driver faces consequences.” The Herkimer Police Benevolent Association has also issued a statement expressing support for the injured officer and his family, and called for enhanced enforcement of the Move Over Law in the area.
The Herkimer Police Department is continuing its investigation into the crash. Officials are reviewing dashcam footage from the officer’s patrol vehicle and are seeking any additional witnesses who may have been in the area at the time. The department has also announced that it will be conducting a review of its safety protocols during roadside investigations, including the use of warning signage and traffic cones.
This incident highlights the importance of driver awareness around emergency scenes. The New York State Police recommend that drivers:
