For HR professionals, leveraging Artificial Intelligence (AI) in leave administration can significantly boost efficiency, but it requires careful human oversight to mitigate legal risks, particularly under laws like the FMLA. While AI can process complex leave laws quickly, subjective decisions requiring human judgment must remain with your HR team. The key to success is a balanced approach that uses AI for automation while implementing strict compliance guardrails.
AI, defined by Congress as a “machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations or decisions,” offers tangible advantages for managing employee leave. Its primary benefit is consistency. Unlike humans, an AI system doesn't experience fatigue or hold biases, meaning it applies the same rules to every leave request. This reduces inconsistencies and potential discrimination, which can help avoid costly civil penalties.
Furthermore, AI excels at handling the administrative heavy lifting. With a complex patchwork of federal, state, and local leave laws, manually tracking eligibility and requirements is time-consuming.
